Where did you get this? There was an EEOC investigation that ended up with no ruling either way. Basically an accusation of the Gadsden flag being displayed as a racist emblem on a coworkers cap. The EEOC investigated the claim, came to no conclusion, and closed without ruling. Everything went as it should have. An accusation was made, an investigation was ordered, no ruling was made because in the eyes of the investigation none was needed. The Gadsden flag remains as a nonracial emblem allowable in in the workplace. Period, end of story. Any baiting being done is for some kind of grandstanding.
How is a neutral ruling the correct outcome? The board stated it could be viewed as racial harassment, but didn't in this casregard. Thus it effectively bans the flag as now employers can and will get sued if they see other employees. The correct ruling would have been it's a patriotic flag and thus not offensive. In this case, after a proper investigation, they decided it wasn't worth bothering over. i fly the 3 national confederate flags while camping and all the time people ask me what they are. (I know thats another ball game). issues of flags can bring up so much controversy.
I also own 'confederate' flag. It passes me off that people hate that flag also, my family helped settle tenn after revolutionary war. I was raised to proud of the pioneer blood and spirit in our family. Now we are looked down on. Hell that flag was passed down to me and had it my bedroom growing up, none of my friends ever said shit, it wasn't considered racist, if anything when we went camping I had to talk to the locals because as they said I 'could speak hillbilly'. Yeah Nip most people have no clue about confederate flag history, there was more than just the battle flag, and the Naval Jack and the Battle flag are different, one has a white border atound it. Had some drunk guys try to come over to my camp site and tell me to take my flags down, talking shit, then when they started threats trying to scare me, I look over and see a charles manson looking dude walking up with a ax in his hand and I had no clue who he was, I thought oh shit here we go, but dude walked up and stood on my side and I actually had to calm him down, he tried to take one of the other guys head off. After shit calmed down and those dudes went back to where they were camping, I was walking with my girlfriend and both those trouble dudes came out of nowhere and one pulled a knife on me, he said while waving the knife around ""I'll put you in the ground!" And said "I just got out of prision!", I told him, you just got out of prison and now you are threating me with a knife?, then I told him didnt your mother ever tell you not to bring a knif to a gun fight? He said "you got a gun?", I pulled out my 9mm and told him if he came at me with that knife I would light his ass up, the look on his face was like oh man I am going to get shot. I could of shot him but he was just a stupid drunk that just got out of prison. Cops showed up asking questions and the prison dude was acting like we were best friends, I did him a favor telling the cops we were looking fire wood, they would of searched that dude and he would of been back in prison. It was a weird and crazy night, all over two guys that didnt know anything about the 3 national confederate flags I had. Oh and turned out that manson dude got a janitor job at the stuido where my band use to practice, some one hit and killed him on his bike and took off. I will always be in thanks to that dude for being on my side.
