Read about a "bust". terrible...

    I read where this guy's house was on fire, and simply put that's how he got caught.

    It made me think, when I was watching cops this one time, they found this lady trying to break into a house, and she had gotten the door open. So they preceded to walk around, they walked in like every room of this ladies house who wasn't even present. Then they tried to hand cuff the lady who was trying to break in, and it took 4 officers, and they broke the owners glass table. Now, if she'da had let's say a grow in her closet, they would have probably been arrested right? Or is there some law behind that?

    Would goto jail. A guy that went to school here with me during my undergrad had something happen like that. Now I didn't know the guy or anything shit there are like 30,000+ students here believe. Any way it was in the school paper guy was getting his masters in architecture. Someone tried breaking into his house and the neighbors stopped them and called the cops. Cops show up go inside and look around. Dude had 110 plants setup in PVC tubes I guess either drip or aero by the looks of it. Sucks man. Although I bet someone knew about it and that was their whole reason for breaking in, although maybe not.

    A guy across the street from me had the same thing happen to him. There was a fire and the neighbors went in and saw a light on in the closet. He had just one plant but that sucks. The guy probably wasn't even growing it properly I mean if he was he would've light-proofed it.


    I wonder how much time the guy with 110 plants got? Does anybody know what the laws are where you live? I know that in my state the maximum penalty for cultivation is 120 days and some fine I can't remember.

    Although, I'm not positive that's just what I heard. You know how that goes.

    You'd think you could put up a disclaimer of some kind, somewhere it wouldn't be obvious unless to any people on the outside of the house. That would look odd to visitors, but if you have none, no harm no foul. I just don't know. I guess you just have to bank on no one breaking in, or a fire.

    Yes that is one of the possible legal reasons for cops to search a house. In the case of an emergency, such as fire, trapped person, foot pursuit of suspect, they can search a house WITHOUT warrant. Now I am going to say that they can only search in plain sight, they cant legally go searching through drawers and such, but im sure they could get away with searching rooms and such.


    Gotta love our laws.

    Yup, in an emergency they can enter and act on what they see. They can even search if they have an excuse like they were looking for a tool or other item to resolve the emergency in some way.


    If they come in on a warrant they are limited by what the warrant says, they can only bust you for whats on the warrant and what is in plain sight. If they are looking for illegal firearms and find a bag of weed in your drawer they can't bust you for the weed.


    Don't push it too much or be a dick though, cops lie like a rug and there are always 8 cops who are more than happy to corroborate the lies. If you piss them off, or they are just in one of those coppy moods that 4 pounds hung from a string attached to the inside of your light socket will suddenly have been discovered sitting out on the kitchen table in plain sight.


    I do know people who were searched for other things including other drugs and got by with shit because of this though. It's all about the wording on the warrant and whether you piss off the cops.

    What if you have a door in the house, that is KEY locked with a note on the door, that states that the door remains locked at all times and no entry is allowed without express consent of the homeowner blah blah blah? Maybe with a pad lock on the outside as well, so it wouldn't be plausible for let's say an escaped convict they are chasing to be in that room...? I'm sure it would draw suspicion, but at least you might have time to burn everything.


    I'm just posing ideas and questions, I think this is turning into a good thread. Or let's say perhaps, you had a storm shelter that's on the outside of the house that's pad locked with chains and such...

    You're absolutely right Shait..


    If they dont have a warrant for whatever they found, they cant charge u with it.. They will take it, but they cant put criminal charges against u for it..


    The police came to my old mans house, when I was younger, with a warrant for my dad. It wasnt an arrest warrant, just a warrant to seize him.. Someone had called the police and told them my dad was driving eradict. They came to the house beating on the door. At the time, I was the only one home. When I answered the door, they said they had a warrant for my dad. I tolld them he wasnt home. They said thy were going to come in and make sure..


    I promised them he wasnt home, and told them there was no need to search the house.


    In the meantime I have my flowering room (400w) in the back bedroom, glowing away.


    They come into my room and see that the bathroom door is locked, and there was a bright light glowing underneath.. They pop the lock and open the hatch on all of my prized clones, flowering!


    I must have shit myself..


    They proceeded to haul all of the plants outside, and into the backs of their cruisers.. Once they had all the plants out into their cars, they took my shroud and bulb, but left my ballast..:icon_scratch: Never did understand that one..


    I also had a small rooting and veg cabinet, as well as another flowering room in the basement. They never found these.


    They proceded to search through my DRESSER DRAWERS. I told them they had a warrant for my father, and there was NO WAY he was going to be in a dresser drawer.. They took High Times mags, pipes, trimmings, NOTEBOOKS, they got my grow log, and a list of all my phone numbers..


    Man this storys getting long..


    Neways they end up trying to get me to rat on myself.


    I told them I had no clue there was weed growing in my room, and I had never seen it before. They tried to get me to write a statement on myself, saying i was growing the plants. (that would be the only way, they could have charged me, if I had incriminated myself).


    Luckily I knew the law, and knew unless I admitted to it, they couldnt charge me with it..


    Anyways, No they cant prosecute u for finding something that wasnt listed on a search warrant!

    Yup. :roulette: Just to be clear, we are talking about the US here. Elsewhere different rules likely apply.
