Well, shit.........I had to once again get rid of everything I had just got started. I got a call from a friend in another state that got busted, but he was a "Bigger" grower and he's in alot of shit, and looking at 10-20 (Say's leo) I didn't want to take a chance his phone is being taped and my number is being looked at and so forth. I guess it's better safe than sorry. Does anyone have any experince or know what Leo does when you get busted as far as going thru phone records, phone tap's ect? I guess, my buddy had a buddy that got busted for some serious shit was all he said, and that the guy was pointing fingers at him to get time off of his deal. When it rains it poor's.........
thats a bummer man,the laws are soooooooo fooking tight over there, hope everything comes out ok for you jcio
That's exactly whey when I moved I told everyone that I stopped growing to protect myself... SEcutiy is #1 !!! As far as the cops looking at your number, possibly. If they are looking for his buyers then they may be going through his phone records.... If I was you I would not grow anything for a while...:icon_confused: I would be scared shitless to grow again....
I seen this on the norml site....can someone explain it a little better to me? Am I to understand that 25lbs is considerd 25 plants on the second line? It does not say anything about qty of plants until the third line down? I'm confused. Are they considering 1 plant = 1lb no matter how many plants or what their weight? Sale or Cultivation ------------------ Delivery of 20 g or less misdemeanor 1 year $1,000 25 lbs or less felony 5 years Prison and $5,000 fine 25 to 2,000 lbs (or 2,000 plants) felony 3 years MMS*prison and $25,000 fine.
How is it that25 lbs or more is less time but bigger fine than under 25? That pisses me off though if you have a 3 foot mom and you take cuttings a day before you get booked and you get 30 clones youd be hit with the heavier punishment. Where are these laws for jcio?
The law's I posted are from FL. I don't understand how it's worded so to speak, I guess I need to wait until my friend talks to a lawyer and see what he's really up for. Where he lives, the laws are a little less strict.
I'm pretty sure what that says is if you have 25lbs or busted with up to 2000 plants that there is a mandatory minimum sentence of 3 years in the pin, so looke like no matter what he is going to be getting atleast 3+ years.Thats the difference ismiel, for under 25lbs you can get upto 5 years(but you could probably get off with just probation only also), with 25+ you get 3 years no matter what and it can go up from there.
Thanks for clearing that up. I'm sure that he is a first time non violent offender which could go as far as keeping him out of jail. Thats what keeps me sane anyway. If i get caught once by cops im done no way im doing time for smoking weed just like im not going to rehab for the same reason. Weed shouldnt be a jailable offense i mean how many legit problems in the community are caused by weed dealers. No potheads are on the street homeless because they sold their house to get baked. Rediculous. Crack is a different story but weed isnt the same ballpark league or even game as crack. Keep us posted on your buddys status. And was he a first timer non violent etc ?
Hopefully if he is a first time offender and has a decent attorney he can get off with probation, or maybe house arrest. Either way it's wrong. I wish him the best of luck.
to hear about your friend Justcheckingitout,, Ive been searched before I only had a 20 minute warning,, I was busting walls apart with my fist I didnt have time to find a hammer.. I had two 4x4 rooms mylar lined with a 400 hps in each and a 2x3 room with a 250 hps as my mother,, bubble cloner room,, Like I said I had a 20 min warning my wood stove was full and burning hot when they showed up,, That was 17 months ago Im still to scared to plug in a light,, I wish you luck Justcheckingitout,, That was a good call breaking down no plant is worth prison.. Im thinking about starting back up but memories of those two days they searched me keeps comeing back,, I was never charged with anything but being searched was enough,,Good Vibes are being sent your way
It fucking sucks, he has no cash for a lawyer since his bond was over $30,000 and everyone that put in to bond him out has no more money to help with that. So am I to understand that if I had 25 small plants total, I would fall under the 2nd line of this FL law below? I'm still confused as to "25 to 2,000 lbs (or 2,000 plants)". Is it saying 25 lbs to 2,000 lbs and or 25 plants to 2,000 plants? FL LAW ------- 25 lbs or less felony 5 years Prison and $5,000 fine 25 to 2,000 lbs (or 2,000 plants) felony 3 years MMS*prison and $25,000 fine.
I just found this......I'm going to post it on another thread if the mod's don't mind. Looks like this might be the answer to the question I posted above.. --------------- REP. THOMPSON SEEKS TO TOUGHEN MARIJUANA LAW TALLAHASSEE - Southwest Florida has had a long history in the battle against marijuana trafficking and production. Its history is replete with tales of abandoned airplanes, bales washing ashore and remote fields scattered about. But times have changed. Just as biological engineering has improved the quality of such crops as corn, soybeans and rice, science has also had a hand in this cash crop. Refined growing techniques and enhanced strands of marijuana have made the plant up to 15 times more potent than crops grown 20 years ago. While techniques have changed law enforcement has not. Enter Rep. Nick Thompson, R-Fort Myers, who is trying to update state laws to adapt to a changing illegal business. Growers now don't need to find remote strands of countryside to profitably cultivate their crops for commercial sale. Armed with new technology, they can as easily and more profitably set up in a house. Grow lights, climate control and a caretaker to tend to the plants in exchange for room board and a little income becomes an increasingly attractive option. With potent marijuana selling at $4,000 a pound and up, many growers have learned that quality trumps quantity. The use of such grow houses have been on the rise in recent years. Florida is only outnumbered by California in the amount of grow houses. As of 2006, law enforcement uncovered marijuana grow houses in 41 of Florida's 67 counties, according to House estimates. Under current law, investigators must find 300 plants to determine that a defendant was growing the crop to sell. Thompson's bill would change that by reducing the number of plants needed to be considered a commercial crop. The measure is scheduled to make its last committee stop Tuesday before going to the House floor. A similar bill is traveling in the Senate. Thompson'- bill reduces the threshold to 25 plants. It would also make it a third degree felony to own, rent or lease a house mobile home or other structure for the purposes of establishing a grow house. The proposal would also bump the penalties up to first degree felony if their was a child living at the house and allow law enforcement officials to destroy growing equipment once their investigation is complete. "In Florida, those who use grow houses to traffic drugs belong in prison," Thompson said recently. "Under this legislation we are clearly telling drug dealers, 'if you grow, you go.' "
Well, I got another chance to talk to my buddy, and he is getting royaly fucked......they weighed his trash pile, and from 5 years of throwing branches, stalks etc on the pile....he was over 50lbs.....so mixed with his plants, he's going to jail for a while. He's so freaking out. I really feel for him.
Pro bono...? Your friend needs a LAWYER, PRONTO.....Search, search, search......:icon_confused: Sign away the car or something....:icon_confused: Laws are messed up, though...See, here, :eusa_shifty: they couldn't count the sticks and trash, has to be "smokable" or alive in pots to be considered "plant material"....And YES, Ish, clones, whether 2' tall or full grown, are considered the same thing, individual plants, ...But again, here, they pull the plants and weigh them all together, they skip the # of plants(in most cases, unless it's a major field bust )Which is not fair, because you know that 90% of the plant is WATER!:icon_confused: Still, your buddy needs a lawyer, and if I were you, I would have one on backup as well...
They should make a cannabis laws for dummies using plain English that the average stoner can understand
this jus says from 25 lbs to 2000 lbs it says nothing about # of plants. there is a number of plants regulation as well, but this says nothing about it. btw when they weigh your plants they weigh the dirt, hydroton, and anything else attached to the plant, so were talking more than a pound per plant in many cases. when they count number of plants, they count clones, and all.
I had asked him hem if they weighed the dirt. He said they didn't? I take it they ripped out the plant and weighed it with the trash pile, and I don't think they went throu lbs of branches in the trash pile to pick off the smokeable stuff either? He made it sound like they just weighed all plant material.........they must of to get over 50 lbs......it reall sucks, because he didn't sell, if he did, he wouldn't be so poor and I'm sure could afford legal counsel.
Just to be honest: Your friend needs to shut the fuck up and get a lawyer quick. Do an internet search for the area, there are always cheap lawyers for things like this, NORML even has a network going on to find attorneys to help with these type of cases: http://norml.org/index.cfm?Group_ID=3445 The bottom line is, if your friend has a descent record, then he has a good legal chance of getting out without jail time, but certainly will have parole, but he needs to stop talking without a lawyer with him, this isn't a ticket for possession, this is his life he is dealing with. He DOES NOT have to say shit to them, AT ALL, and SHOULD NOT do so without a legal aid. Hit up a local university, the yellow pages, something, there ARE lawyers out there who are willing to take on this type on shit! And most all will work with you financially!
What bugs me is the way cops work out the price/scale of their haul! Aye it sucks to get busted,iv been in that situation and it aint pretty! What really bugs me is they way the cops work out their prices... when they busted a house over here not long ago that was basically a grow home, every single area of the house was being used for growing but the plants were all in vegetation yet the cops tell the press and news media that the bust is the biggest MJ grow op in scotland yada yada yada but how the hell are they gonna tell us it was a £1million bust when they dont even know if ANY of the plants were even gonna be females/sensimelia...they could all have been males and thereby worthless!:disgust: Same when they bust someones home and find a stash of weed, they take a look at it and weigh it up,now we all know that the more you buy the cheaper it is but not so with the cops, they take one look at a few kilos of weed and instead of putting the normal price on it for a few kilos'...they instead work it out how much it would be worth if you broke it down and sold it at £40 a quarter and obviously if you worked it out using there method then its gonna sound like a huge ass bust when in reality its just some growers harvest... i HATE the way cops work out the price and scale of a drugs bust, its all aimed at making their score look bigger and better than it really is... otleaf:I REALLY DO HOPE I SEE AN END TO PROHIBTION IN MY LIFETIME COS THIS LUDICROUS SITUATION JUST CANT GO ON ANY FURTHER,NORMAL EVERYDAY FOLKS ARE TOSSED IN JAIL AND TREATED LIKE DRUG BARONS ALL COS THEY GROW A LIL WEEDotleaf::angry4:
sorry everyone, i exaggerated a bit since i hate how theyll do anything to slap a bigger charge on us. they uproot the plant sometimes weighing a big dirtball along with the roots, vegetation, and all. they are so uneducated that most of the cops who bust you think you can smoke all of the vegetation. when my buddy got busted with an aeroponic setup, he said they wouldnt handle anything without hasmat suits, with airfed hoods as if they were handling a meth lab. they really think the ferts, an whatnot we use can explode or something, an that we are supercharging our plants infusing them with crazy chemicals making a different drug. what a bunch of twits!
