Gotta love the cops! (Long story)

OK ... so I got arrested today! Wooohooooooo!

My lawyer is going to have a FIELD DAY with this ...

I was leaving work today to drop off some same-day deliveries at UPS, well ... pigs stopped me. Let me set the scene ...

Quiet morning, about 10AM driving out of work in a F250 with company logo, phone number, etc. on the tailgate and doors of my truck. I seen a cop at a light, I turned at the light, and didn't think nothing of it till I heard sirens going. He had lights on for ~3-4 blocks before I stopped I guess, I had the back of my truck filled to the headliner as well as the passenger seat packed with boxes and the bed of my truck had ~1200lbs of plow blades. All ready to get shipped ...

He told me to get out of my car, gun drawn when he came up. I've got 20% tint on all my doors, because my prescription says I can! I got out of my car, locked the door behind me. Mind you, I'm in a suit ... I had a lunch meeting with another business owner at noon.

I advised the officer I was licensed to conceal carry, and I had a pistol at my 5 o'clock. He flat out tackled me, gun still in hand put an arm on my back and shoved me into the truck and took me to the ground and then cuffed me.

$2,000 suit ... ruined.

Takes my gun, knee on my back, and sets it off to the side. Then he commented on how "nice it was" and how "it's too bad that I'm dumb enough to carry it". I had my phone turned on recorder for all this ... I'm smart, thanks to Stinky for the idea on how to do this with my Blackberry!

So I'm on the ground, cuffed, and I told the cop "You just made a BIG mistake!" ... he gets cocky with me, and asks me why.

For one, I'm licensed to conceal carry. If you would have let me give you my identification you would know that, and if you ran my name OR license plate, you would know that... Two, I've got a prescription for my tint and I had NO possible way of seeing you behind me. My truck usually tows a 24' trailer, so I've got wide rear view mirrors and I've got a ~30 foot blind spot behind me. You were within 2 feet of my bumper (according to the in-car camera) ... I couldn't have possibly seen him, or his lights behind me.

So this guy gets even more cocky with me, and says "Oh you think you're so great ..." and digs for my wallet, truck keys, cell phone. Notices my cell phone is on a call, and asks me what it's doing. I said I turn my phone on for police encounters and record them to my attorneys voicemail.

He had a look on his face like :icon_confused: and hit "End" and seen my phone's background, which is a pot leaf design among other things ...

Digs for my wallet, and finds my pistol license behind my ID ... and says "oh maybe you weren't about the gun"

Then he opens my truck (which was LOCKED and windows rolled up) and says "Got reefer? Smells like it! I think there's a reason for those red eyes!" and starts digging through my center console, finds a roach or two in the ash tray and opens my cigarette pack to find 4 spliff's.

Takes it, doesn't hit the "Lock" button on my truck after he's done and throws me in the back of his car.


OK so this douchebag brings me to jail, and the Magistrate set a $20,000 bond on me. I asked if I could make a phone call, the answer was no.

so I'm sitting in the drunk tank, $2,000 tattered suit ... I call my bank collect (private number to the bank manager ), and ask her to send $20,000 to the jail for my bail.

About 30 minutes later, I'm released.


Apparently ... I'm going to be charged with

Posession of marijuana, over 30+ grams?! ... yeah, tell me how 4 joints and 2 roaches are 30 grams. And explain how it still fit in my cig pack?

Federal firearms charge, since I committed a crime with a gun in possession.

Evading? ... what cause I kept driving down a street with no place to pull over, with no way to see/hear the cop until he hit his siren?


... ugh, I figured I'd share.

Steelcity, I'm sorry if your taxes go up but I am taking this as far as I can go. Harassment, illegal search, illegal procedure ... any and everything I can get. I'm going to make sure the city of [somewhere in PA] pays for my suit, $30,000 worth of packages that didn't get sent out today, all business expenses, the 1% for the wire charge to bail me, and I'm going to make sure that cop loses his job. AND I'm going to get the fucking idiots for not allowing me to hit the West coast this week per terms of my bond (must stay within the state), and get the City for ANY and ALL operating costs I lose because I can't be on the West coast to run my business! :5headache: ... aswell as the Kimber Custom Carry that hasn't yet been returned to me (that I was legally allowed to have in the first place), that's $2,000 plus a $300 holster I'll add onto their bill.

Funny actually, my lawyer was at the jail waiting to meet with me when they were taking me to be released. I hope this makes big news and I'm the next Rodney King, but I will make these people pay. The cop has a wife, brand new car, etc. etc. (one of my friends know him) ... and he lives paycheck to paycheck, nice new house in the Burbs ... wife does some daycare BS and is taking college classes for her Masters.

I'm going to make sure he DOES NOT work for this department any longer ... As bad as this sounds, I hope he falls flat on his face without a paycheck.


My lawyer has flat out said "Don't worry about anything, you're going to have the last laugh".





Apparently the new "stereotype" is 23 year old business owners, in suits. Be careful out there.

Yeah, I have an employee whose brother is a cop with another department from the town I live in (I live and work about 30 mins apart). Well, I got his phone number and I'm waiting to get a hold of him (left him a voicemail) to see if he can find out what the Department's procedure is with traffic stops. If they all are recorded, some, or what the deal is.


I'm *pretty* sure policy among most big cities is to record, just incase something like World's Wildest Police Chases ... And if he wasn't recording, then the Officer may have broke Department procedure and that right there is grounds for SOMETHING to be put on his record.

I haven't got a clean-cut answer on why I was pulled over, I used a turn signal (I seen a cop, I was covering watching my ass like I'm sure EVERYONE does when a cop is around), I never exceeded 35mph which is the speed limit on that road (I was doing 30, I had almost 2,000lbs of crap stuffed in my truck). I think he just felt like pulling over the next person he saw, I don't really know what it was. My attorney has called 8 times, talked to Lt's, Sgt's, and the Prosecutor trying to find out what the reason for pulling me over was.


Shine ... Prosecutors always say "We're slapping you with the FULLEST extent of the law" ... well, I'm going to reverse that role.


I like the motto, "To protect and serve" - but that's only the start of the sentence, the rest of it is "the Bureaucrats who approve our salaries"

The picture on my phone was this bikini, that I got for an Ex-Gf years ago that I barrow out when people come over to my house and go in the hot tub.


One WELL endowed girl from a bar was showing off to everyone that was over one night and I got a picture up-close-and-personal of the goods from about 2" below nipple up lol ... distinctly could make out the leafs on my phone, that gave this fag probable cause?

I had a recent run-in with a douchebag cop last week for doing nothing more than chilling on the riverfront with my lady friend laying in the grass just got done burning one. I guess I look like a 35 year old gutter punk? Anyway, just sitting there chilling with the sunglasses on when I get a nuckle to the head from behind. "HEY KIDS Y'ALL CAN"T SLEEP HERE!" So I turn around see a cop and I say, "What are you, some kind of Douchebag?" Not the best thing to say, but WTF? The dude just ruined a great moment. GRRRRRR.....


So, after a few other choice words back and forth He procedes to take me to jail for Public Intoxication. Dude!!!! Public Intoxication?!!!!! This is fucking New Orleans, you jackass!!!! That was a saturday. I got out the next MONDAY and seen a judge who threw the charge out. I would admit partial fault for this but he just had no right to knuckle me in the back of the head in the first place. I guess I'm lucky that it was Daytime and I wasn't on guard for a robbery. Coulda got a lot uglier. Really not the worst mistreatment by Police officials I've encountered but thought I'd share.

Couldn't sleep last night, I don't know ... 4 bong loads and a joint and I was toasted, nodded off for a few hours and got up. I'm off to the police station with my lawyer right now, shift change is coming soon and we're going to have a "Talk" with the Cheif, on-duty Sergent yesterday, aswell as the Officer and get any footage we can.


Apparently, it is pretty much a state-wide policy among PA LEO's to record traffic stops, so there SHOULD be something. If not, I'm going to DEMAND that the Officer be suspended for breaking procedure and infringing on my rights, and ask that my pistol be returned, all charges dropped, and a FORMAL PUBLIC APOLOGY from the Cheif, after the officer is relieved of his duty.


I don't care about the money, or 15 minutes of fame in the paper and local news, or becoming a Martyr for potheads everywhere, I want to ruin this pigs life.

 

That sucks bad John. That cop was a prick for sure. I'm sure you were driving properly at the time. Anybody with half a brain and 4 spliffs in the car should be following all traffic laws. I can't believe he so blantantly violated your rights even to go so far as to unlock your truck and search it without any probable cause. Wow!!


I hope you take this pig, and his department to the cleaners. However, I think it's gonna be tough to get this douche fired regardless of what he did. They tend to protect their own. My prediction is they will admit no wrong-doing, once it's over, you will get your gun back with no problems because they had no right to take it in the first place, but the rest will play out in court. Hopefully to your advantage. "Tell it to the judge" seems to be one of their favorite lines. Worst part is all the time and money you have to spend to fix this.

I think that is how you spell it. They even put his e-mail address and phone number in the post, so people could harass him. I love it. :love4:

 

To the first part - WORD!!! I watched that NORML video or whoever made it, protecting your rights ... YouTube video, was a pretty popular thread here so I'm sure most everyone seen it. Since then, I only roll my window enough to speak to him and hand him whatever he asks for, and if they ask me to step out I lock the door behind me. Learned two things from here :laughing5:


Anyway ... I had fun this morning. Attorney and I walked in, chests out, shoulders back, chin up ... waited about 20 seconds for the Cheif, who already had the officer in his office and was apparently reviewing the footage.


There were some "discrepancies" (as they put it) between the officers arrest report, and what was seen on video. My attorney let the officer hear the ~3 minutes of audio before the dick shut my phone off ... oh man was that a priceless moment. The police Chief had the "Oh shit, you didn't" look and the cop had the "Yeah, I did but I won't admit to it" look (I've got a kid, yeah -- I know the look)..


So I listened to their bullshit, about policies and handling situations with people who fit certain descriptions ... to which I didn't understsand ... the Chief explained that if a person seems to be an immediate threat or uncooperative, that they would usually be put under restraint. I was in a suit, dress shirt, pants, shoes ... the works. I was driving a truck that won't do better than 120mph, and if it DOES get to that speed I'll probably only make it til the next gas station anyway :icon_confused:


But anyway ... it IS department policy to record traffic stops, and also it's policy to make any traffic stops off busy roads, because there's usually nowhere safe to pull over so trying to find a side street is a plus.


(That kinda goes against the evading, now dun'it?)


I wasn't going to even try to argue my side, they said the Prosecutor had the case now and they couldn't do anything more.


(Yeah ... put the responsibility on someone else)


So ... my attorney reached into his stack of papers and slapped a supeona for the footage, since they wouldn't release it to us because "they were still waiting for reports to be filed" -- yeah, bullshit. I've got a copy of the officers report, and no where does he make an indication that he had filmed the incident, nor that I had recorded it onto my cell, or his shutting my cell off off, or his "probable cause" being the photo on my phone and the "smell of marijuana and redness of the eyes", or my refusal of consent to search (Yeah, like I was really going to say "Feel free, search my car" when I'm in cuffs laying face down in the street)


Whatever the time was he called the stop, was 3 minutes off of the message left for my attorney. Sure as shit ... my cell phone is 3 minutes faster than the clock at Central Dispach ... OOPS, "discrepancy #..." oh wait, anyone counting?


Cheif started to sweat, I could see it under his crappy comb-over ... read over the Supeona, and said "We cannot forfeit the video yet" ...


So a harassment suit hit the table ... lol now the Cheif was tapping his fingers on his desk and the faggot kept going over his uniform every 5 seconds looking for lint or boogers or something ...


Annnnddd then the Cheif laughed at it and stated "Well this is bogus, we made a routine traffic stop ..." ... well, I liked how it kept coming out as "We" - ... "We did this" "We did that" when the Cheif talked, the cop talked about HIS actions. The Cheif was taking responsibility for this asshat!


So we promptly got up once I really started getting annoyed at the B.S. they were touting, went to courthouse ... and filed everything we needed to proceed criminal charges as well as a class action suit against the Department and ... well, if I really wanna be a dick - the City itself.


I've had 4 phone calls from that police department since about 3:00 ... it's 5 now ...


Sum totaling around $84,000 if I lose only a week out of this .. if it's more than a week I'm held up on the East and can't get to the West (terms of bond hearing, they won't let me leave the state to run my own business since I'm a flight risk ... yeah ...)


So, if I get stuck at home for any time in May that number is going to continue to get bigger and bigger and bigger till that shithole they call a town doesn't have a single cruiser and rollerblade cops are bitching for WD-40 :laughing5:


pretty uneventful really ... I've had 4 glasses of southern comfort to celebrate so I apologize if it's hard to understand.


PS is no object I spent nearly $15,000 to get the shithole to overturn a law that prohibited exhaust fans on industrial air-exhanges to vent outside towards ANY other businesses, roads, houses, etc. The way they inforced it was totally bullshit, and I won ... saved me ten times that in rennovation costs.\


Now I'm just out to make sure that Cop doesn't have a badge.

yrs. ago, I was stopped for DUI in a very rural area. When at the hospital, I refused to cooperate with The Blood Draw 'till they loosened the cuff's...I'm diabetic, with neuropothy and my fucking hand's were numb!(let's just speed-up the fucking nerve damage!!).


Anyho...the fucker tries to force me to comply, so when he stood me up(I'm still drunk, mind you! LOL!), I feebly attempted to kick at his shin. SOB THROW"S me to the floor and add's Assaulting An Officer to the charge's(later dropped).


When we get to the station(2nd floor), one of the asshole's pushes me and I damn near slam my head off of the top step! If only we were a few step's lower, I would have had the Bastard's! It seem's like they may have perfected that stunt! As they're processing me, they won't let me pee(BEER!)! Only after I threaten to piss all over thier floor, do they escort me to the men's room.


On the way to jail, they're FLYING thru windy back road's. I'm yelling at them


to slow the hell down!


Not all local's have dash cam's yet, but the Trooper's have for yrs. I believe, if a cruiser has been outfitted, policy is that they must be on; as soon or soon after they notice the offense/hit the light's.


From what you've related, you're looking pretty good.


I'm not the kind to want to see ANYBODY struggle, but in this instance, "off the force" is the only way a local yokal will "get it!"


If the humility of losing his position doesn't work, maybe actually "working", for a change, will.
