    "Maryland's medical marijuana law is stricter than those of other states; under it, the drug is still not technically legal to possess or distribute. Instead, the new law makes "medical necessity" a legal defense for being prosecuted for marijuana possession. Rather than legalizing marijuana for medical use, the law reduces the legal penalties for getting caught using marijuana for medical reasons.

    The legal defense applies only if a doctor has diagnosed someone with a debilitating medical condition that is resistant to conventional medicine and for which marijuana is likely to provide relief."

    In other words... "Come get your name on a list at the doctor's office, then you can smoke at home and get prosecuted week in and week out because you effectively 'raised your hand' when we asked who smokes marijuana..."

    Medical necessity defense is a solid step. What the lawmakers have effectively said is, "We're too chickenshit to do the right thing so we'll step out of the way. Find a Dr. to recommend and challenge it in court. We've paved the way for the ruling that will set precedent."
