The estate can still bring a wrongful death claim against the cop and the PD, and they will recover. Still, that's cold comfort for the parents of the person killed, and if the word amongst the general population, including other cops, is that he got off, there's no deterrent effect. You gotta wonder if it was an accident or intentional. Could have been a little of both.

Assumption of risk is a defense that is raised when the occurrence that leads to injury should have been anticipated by course of dealing. In this case, ramming citizens suspected of traffic infractions is against the NYPD's policy, and this happens infrequently, so he had no reason to assume the police would kill him for riding a dirt bike.
Seriously man? So the committing of what at the worst is a misdemeanor offense gives cause to mowing somebody down with 3500 pounds of steel? God forbid you refuse a felony search warrant or try to duck out the back if the cops ever show at your door. By that logic they'd be justified to drop you on the spot.
Who really knows what these idiots did, or were suspected of, prior to the tape. Reguardless. If you had to deal with this type of asshole (without being specific) on a daily basis, I'm certain that you wouldn't feel so sorry for them. If I can't ride dirt bikes in the city, neither can they.
The survivor was charged with reckless driving and resisting. Hardly a dangerous perp deserving of deadly force. They record is they were hotdogging and riding up on the sidewalk then attempted to flee the police. Stupid? Yes. Deserving of a citation? Yup. Deadly force? Not even on the map. Anybody who would rage enough to run down a guy for a misdemeanor shouldn't be allowed to carry a weapon much less be on duty. And the solution is to simply run them over until they're all dead?
Those cops were not justified in their action in the least! Get real. Unless dude on the bike just fled a mass shooting or something there is no justification for taking the guys life. Period. That cop made a decision to use deadly force in a situation that clearly didn't warrant it and should be at least charged with and convicted of manslaughter. I've been convicted of Reckless Driving, it's a good thing the cops didn't decide to shoot me or run me over. I was a dumb kid who made a dumb decision and that mistake doesn't justify the use of deadly force by the arresting officer.

That's like national guard level crazy. They rode by a cruiser, but there are like 200 of them. I'm sure the noise is terrible. Here in suburbia, we have the summer time harley packs that come roaring through on occasion. I admit, it rankles me. But not enough to want to run run over anybody.
