Kushner doesn't know shit about this. His company sold the debt or the collector is working on a percentage basis. You know how it works. You buy a building, an accountant identifies recoverable debt then informs the owner. Accountant then hands over a stack of documents to a paralegal who starts the processes. The owner never sees more than a number on a spreadsheet. About 20 years ago a local rail spur that ran through a wealthy Minneapolis suburb was sold at auction. Everybody thought the guy who bought it was crazy since it was a useless corridor with no possible value. The cat then surveyed the entire rail spur and served notice on every adjoining property owner who had encroached on the Right of Way he now owned. Garages, sheds, fences and the like. It was frivolous as all fucking hell! But enough guys living in multi-million dollar mansions paid up rather than risk a cloud on their title. The new buyer of the rail spur made a few million $$ then abandoned the property. It became county land (who finally paid to have the old rails removed) and is now a bike path. Guys do some fucked up shit for $$$$. But stories like that Kamiia one. That's some right cold heartless shit and pretty fucked up. You got to figure the previous owner had already written off any uncollected debt aged over 1 year as a loss against income on the partnership K-1's and tax return. If they didn't it would be the first time in real estate investment history. At that time the debt ceases to be carried forward to subsequent years, or, successive owners. That means Kusher's company is double dipping and someone somewhere has to account for the previously claimed losses as they are recovered. It's an IRS thing, and the thing is they won't come looking for Kushner's company. They'll be after the previous owner who used the debt to offset income and that cat could be required to write a big fat check for a property he no longer owns for money he never actually received. Right sweet deal if you're a piece of shit with no ethics or sense of human obligation to people you do business with.
Not double dipping. She got written permission to leave months before the fact. She did not break the lease. She got swept up in a "collect everything" handover to a law firm, and a clerk of some kind made an error. This was years after she had moved out, and Kushner didn't own the building when she lived there. He bought the company, and as a result the collections efforts were stepped up. The lawyer may or may not have known she didn't break the lease because his client was telling him she did. They are not paid to be fair, they are paid to win, but interestingly, they had no documentary evidence that she DID break the lease. The judge just sided with the real estate company lawyer on the pleadings without evidence, even though the burden of proof is on the plaintiff at that stage. Oral assertions made by lawyers in court are not evidence, unless they are made as witnesses under oath and can be cross examined. Pleadings are not evidence. Thems the rules folks. That is black letter reversible error on appeal. Her first court appearance she didn't have the letter she received from the landlord that confirmed she did not break the lease. Only after the judgement was filed did she present the letter, which was (unless you are Jared kushner) too late. But now he knows. As in today. It's not a number on a spreadsheet (or the balance of an account) to him anymore. It's public knowledge. He could make it right. He's fucking God for christ sake. I was speaking to the tax accounting. If there was a loss or uncollected debt attached to that tenant it would have been written off by the previous owner which is the common practice for aging rent collections. If Kushner comes along and collects the "outstanding" debt then that's double dipping according to the IRS. You can't collect a debt AND keep the write off. I'm not an accountant or attny, but worked in commercial real estate as a CPM before everything blew up in my face. If it's this obvious to me....I wonder why some IRS droid can't figure it out?
